PRIVACY POLICY
Ride Entertainment Systems and F3 Amusements, LLC (collectively “RES,” “we,” “us” or “our”) own and operate the rideentertainment.com web site (“Site”) and Skycoaster operates the online store at skycoaster.myshopify.com (the “Skycoaster Store”). This privacy policy (“Policy”) contains details about how RES collects and handles your information when you use the Site, the Skycoaster Store and any other web site or mobile app where this Policy is posted or published, when you provide it to us voluntarily over social media services owned and operated by third parties such as Facebook and Instagram, or when you otherwise interact with RES (collectively, the “Services”).
This Policy applies only to information we collect from you through the Services identified above, and does not apply to information which you may send us by other means. Other web sites, mobile applications, and other online services, including the social media platforms you use to interact with RES, may have their own privacy policies, and you should consult those accordingly.
The Services are intended for users 18 years of age or older. If you are not 18 years of age or older, you are not permitted to access or use the Services.

Policy Changes —
RES reserves the right to change this Policy at any time. Since this Policy may change as we modify or expand our Services, we suggest you check back from time to time in order to understand how we treat your information. Our Policy’s effective date will always be set forth at the beginning and end of the Policy. Any changes will be immediately incorporated into this Policy, and will be prospective only. We will not make any changes that have retroactive effect unless legally required to do so.
Any change to this Policy is effective immediately. Your continued use of the Services after any changes are made to this Notice constitutes your acceptance of the changes. If any changes are unacceptable to you, you should cease all use of the Services.
If any changes to this Policy materially affect how RES treats or handles personally identifiable information that you have already provided to RES or that has otherwise been collected by RES, we will notify you by email (if RES has a valid email address to use) and give you thirty (30) days to opt-in to the changes as they pertain to your information. If you do not opt-in, your information will continue to be used in a manner that is consistent with the version of this Policy under which it was collected, or the information will be deleted.
Collection and Use of Information —
Personally identifiable information (“Personal Information”) is generally defined as information that, by itself or in combination with other information, is reasonably capable of being linked to a specific individual or household. Personal Information can include, but is not limited to, name, physical address, telephone number, email address, username and password, age/birthdate, credit/debit card number or other payment information, photograph, office address and other business information, biometric data (e.g., fingerprints), state and/or federal identification numbers (e.g., driver’s license number; social security number; passport number), or any other type of data that, directly or indirectly, is reasonably capable of being associated with you.
There are areas of the Services where you may be asked to provide RES with Personal Information or other data, or where such Personal Information or other data may be collected from you in an automated manner. For example, Personal Information (and other related data) such as your name, shipping and billing address(es), email address, phone number, password or other account access information, credit/debit card or other payment information, and/or internet protocol (IP) address and other persistent online identifiers may be collected from you when you:
- contact RES with questions, comments or other messages;
- order RES products through the Skycoaster Store;
- purchase a Skycoaster gift card;
- sign up to receive Skycoaster special offers, giveaways and other communications about Skycoaster products and services;
- participate in Skycoaster contests, sweepstakes or other promotions;
- complete and submit your answers to RES surveys and questionnaires; and/or
- otherwise provide any information to us voluntarily through the Services.
Depending on the nature of the activity, such as if you publicly upload or post content with Personal Information through the social media aspect of the Services, other users of the respective social media service and our Services may be able to view your Personal Information.
RES may use your Personal Information and other data to:
- process orders and payments for gift cards, products or services offered on or through the Services;
- maintain proper business records and other relevant records;
- respond to your questions, comments or other messages;
- send you communications about RES products or services;
- contact you regarding your orders and shipments, or if there are issues with any content you may have uploaded or posted through the Services;
- administer RES special offers, giveaways, contests, sweepstakes or other promotions;
- process your responses to RES surveys and questionnaires;
- provide ongoing technical support related to the Services;
- communicate with you regarding additional uses of your Personal Information beyond the scope of this list or the Policy;
- improve the content and general administration of the Services;
- perform internal operations related to the Services (e.g., fraud prevention);

Skycoaster uses Shopify to provide certain e-commerce support services to power the Skycoaster Store, such as hosting and payment processing services. Shopify may receive and process portions of your Personal Information on our behalf, such as your billing address, credit/debit card number or other payment-related information. Cookies and Other Tracking Technologies
There are areas on the Services where RES may automatically collect certain pieces of data as you navigate the Services and elsewhere online, such as your IP address and other data about your internet connection, your operating system, browser type, and other services or equipment you use to access the Services, and usage data. This automatically collected data generally does not identify any specific individual, but to the extent such data is reasonably capable of identifying you or another person, we will treat such data as Personal Information.
For example, the Skycoaster Store and other Services may use cookies. Cookies are files that are transmitted to your computer when you visit a web site. Cookies allow Skycoaster to recognize your browser when you subsequently return to the Services. Cookies may also collect your user preferences when you visit the Services. Skycoaster uses the following cookies to optimize your experience when using the online store area of the Services.

Third-party cookies may be used through this process to track data such as the times you most frequently use the Services, what devices you use to visit the Services, what parts of the Services you visit and the links you use to get there. These data and analytics service providers may use such information to track how you use the Services, measure the performance of the Services, improve features on the Services, and provide overall operating needs. RES may then use feedback from these service providers to improve the Services and our communications with you.
All of the above-referenced IP addresses and other data will be collected in an automated manner and we may maintain it or associate it with certain other Personal Information we collect in other ways or receive from third parties. This helps us improve our Services, deliver better and more personalized services, estimate our audience size and usage patterns, and store information about your preferences.
By providing to RES the Personal Information and other data referenced above, you agree that RES may use such Personal Information and other data in accordance with the terms of this Policy.
Sharing Information —
If you are a resident of California, applicable California privacy legislation permits visitors who are California residents to request certain information regarding RES’ disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request to access such information, please contact RES at info@rideentertainment.com. Within thirty (30) days of receiving such a request, RES will provide a list of the categories of Personal Information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. RES reserves its right not to respond to requests submitted other than to the address specified in this paragraph.
RES may share certain portions of Personal Information with its vendors in order to make the Services function properly. This may include sharing Personal Information with:
- Shopify to provide hosting, payment processing and other services in support of the Skycoaster Store;
- other payment processors that assist with transactions on the Skycoaster Store; and/or
- shipping companies in order to send you products you order or request through the Services.
If you order custom merchandise, RES may share your Personal Information with Custom Ink to help fulfill your order. RES will disclose your Personal Information or other data if it reasonably believes it is required to do so by law or in cooperation with a government or law enforcement investigation. RES may also share Personal Information or other data in order to avoid imminent physical harm to any person or damage to any RES property.
RES may share your Personal Information or other data with a third party if our ownership status changes, such as if RES is acquired or if we acquire another entity.
Other than what is referenced above, the Personal Information and other data collected from you is neither shared with nor sold to any person or entity outside of RES.
Your Choices —

Any removal of content by RES does not ensure or guarantee complete or comprehensive removal of the content in all places. The content may have been shared or reposted by other parties, or federal or state law may require maintenance of the content or information. RES will do its best to accommodate your request, but we cannot guarantee we can remove all Personal Information from the specified uses. Therefore, please be as specific as possible in your request. If the request relates to information that RES needs to make the Services function properly for you, you may not be able to use the Services properly moving forward.
RES reserves the right to maintain proper business records as required by law, or for otherwise legitimate business purposes to the extent permitted by law, even if such records contain your Personal Information.

RES does not knowingly collect any information from minors, nor are the Services directed at or intended for minors. If a minor uploads or posts information through the Services without authorization, and such information becomes publicly available, please contact us immediately at info@rideentertainment.com. If RES learns we have collected or received any minor’s Personal Information, we will delete such information immediately. Again, any removal of content by RES does not ensure or guarantee complete or comprehensive removal of the content in all places. The content may have been shared or reposted by other parties, or federal or state law may require maintenance of the content or information.
Because there is no consistent industry understanding of how to respond to “Do Not Track” signals, RES does not alter our data collection and usage practices when we detect such a signal from your browser.
Data Security and Retention —
RES implements, uses and maintains industry standard technological security measures that are reasonably designed to help secure your non-public Personal Information from loss, unauthorized access or disclosure, both in storage and in transmission.
While RES takes the issue of protecting your Personal Information seriously, you should exercise discretion in what information you disclose and/or transmit through the Services. RES cannot guarantee that information sent over the internet is fully secure. The transmitted information may be intercepted by others before it reaches RES. If you are concerned about sending information to RES over the internet, please send the information by mail or call us to make other arrangements. RES is not responsible for the security of information sent over the internet.
RES retains collected information for a reasonable amount of time in order to fulfill the stated purpose for why the information was collected. RES will also retain collected information connected to business records for periods of time required by law. If RES determines that collected information is no longer needed, it will delete such information. Our collection times will be consistent with applicable law.
Children’s Information —
The Services are not directed at, marketed to, nor intended for, individuals under 13 years of age. No one under the age of 13 is permitted to provide any information on or through the Services. If you are under 13 years of age, DO NOT: use or provide any information on or through the Services; use any of the Services’ features; use any interactive or public commenting feature on the Services; and/or provide any information about yourself to RES. RES does not and will not knowingly collect any information, including Personal Information, from any person under 13 years of age and RES will take prompt steps to delete any such information if it is inadvertently received. If RES learns that we have received Personal Information from any person under 13 years of age, RES will delete that information. Non-U.S. Concerns —
The Services are meant for individuals within the United States. RES only knowingly collects information from individuals within the U.S. If you provide information to RES from outside of the U.S., you do so at your own risk. If you are outside of the U.S., you are responsible for complying with any local laws regarding your use of the Services, and any related data collection. You also agree and acknowledge that by providing any information, including Personal Information, through the Services, that such information will be transmitted to, and stored in, the U.S.
If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and processing globally. By providing your information, you consent to any transfer and processing in accordance with this Policy.
How We Handle EU Data —
If you reside within the European Economic Area (the “EEA,” which includes the 27 European Union Member States, Iceland, Norway and Liechtenstein), Switzerland or the United Kingdom (collectively, the “EU”), then RES handles your Personal Information and other data according to the terms of this Policy, unless the exceptions in this section apply to the extent necessary for compliance with the General Data Protection Regulation (“GDPR”).
RES will collect, process and use your Personal Information as described in this Policy and for the purposes set forth in this Policy. With the exception of uses for which we have obtained your consent, your Personal Information is processed in support of legitimate interests as described in this Policy.
If you reside within the EU, we will seek your consent before using your Personal Information to serve you relevant content and materials based on your personal preferences, interests, location and other information that you provide to RES in connection with your use of the Services.
Under the GDPR, users in the EEA have the following rights regarding RES ‘processing of Personal Information:
- the right to request details on the Personal Information we hold about you at any time;
- the right to update and correct any inaccurate Personal Information RES holds about you;
- the right to withdraw any consent for marketing activities or processing of Personal Information that you might have provided to RES;
- the right to request erasure of Personal Information;
- the right to request restriction of RES‘ processing of your Personal Information;
- the right to object at any time to RES‘ processing of Personal Information concerning you; and
- the right to request the portability of Personal Information you provided to RES.

Under the GDPR, users in the EEA also have the right to lodge a complaint about RES’ processing of your Personal Information with a supervisory authority. In particular, such users may lodge a complaint in the Member State where the user lives or works or where the alleged violation took place.
To protect your Personal Information, the Services use appropriate technical and organizational security measures to protect against unauthorized access, alteration, disclosure or destruction of your Personal Information and other data stored on our Services.
RES retains Personal Information only for as long as necessary to fulfill the stated purpose for which the Personal Information was collected or otherwise processed, and thereafter for a variety of legitimate legal or business purposes. These may include retention periods that are: (i) mandated by law, contract or similar obligations applicable to RES’ business operations; (ii) for preserving, resolving, defending or enforcing our legal/contractual rights; or (iii) needed to maintain adequate and accurate business and financial records. We will delete your Personal Information as soon as the respective purpose of use is not applicable anymore and no legal obligation to retain such data exists. Your Personal Information may be disclosed to and processed by staff operating in the United States. Disclosure will be to individuals who work for RES, our subsidiaries, related companies, and companies with which we have contracted to process or store this data on RES’ behalf. The individuals and organizations that receive Personal Information as a result of international transfers out of the EU must follow our express instructions with respect to the use of Personal Information and they must comply with appropriate security measures to protect your information.

The Services may contain links to external web sites or other online services, including those embedded in third-party advertisements or sponsor information, which are not controlled by RES. We are not responsible for the privacy practices and data collection policies for such third-party services. You should consult the privacy policies of those third-party services for details.
RES may also allow interaction between our Services and other online platforms such as social media providers. This may include plugins that allow you to share information with persons outside of the Services. Please consult the privacy policies of such third-party providers before using them to make sure you are comfortable with the level of sharing.
